Dear Mr. Keach,
This is in response to your letter requesting records under the New York
State Freedom of Information Law.
In response to your first request, for "contracts between telecommunications
companies and New York government agencies," the Department of Corrections and
Community Supervision (hereinafter "the Department") has 523 pages of
information available. This information concerns only contracts between
telecommunications companies and the Department, relating to inmate phone
services for the years 2009, 2010, 2011 and 2012. The Department does not
maintain records of other "New York government agencies."
As it relates to your second request, the Department notes that it was not
receiving any commissions from offender phone calls during any of the specified
time periods.
In response to your third request for "calling rates," the Department's
response is set forth below. The rates for the time periods are as follows (all rates
are combined local and long distance rates - there is no rate difference between
collect or pre-paid calling):

As it relates to your fourth request, the Department notes that there were no
audits between 2009-2012. Last, in response to your fifth request, the Department
has three pages of records responsive to your request.
In total, the Department has 526 pages of records responsive to your request.
Please submit a check payable to the New York State Department of Corrections
and Community Supervision in the amount of $131.50 covering the photocopying
fee of $.25 per pag~. Redactions have been made pursuant to Public Officers Law
§87(2)(b), 87(2)(d), 87(2)(g) and where information is not responsive to your request.
