Before the court is Plaintiffs’ petition to engage in limited discovery in this
case. (ECF No. 32) The court has considered the arguments within this petition as
well as those in Defendants’ opposition (ECF No. 33), and notwithstanding the
stay of the case that this court issued on September 8th, 2014 (ECF No. 36), it is

ON THIS 8th day of September 2014 hereby

ORDERED that Plaintiffs may file a motion with this court for the production
of specific, limited discovery, and the court shall grant the motion where the
Plaintiffs can show:

1.) The discovery sought cannot be obtained through the Plaintiffs’ own
efforts in the absence of a court order; and

2.) The discovery sought is not duplicative of discovery likely to be produced
in the administrative proceedings that may be held before the Federal
Communications Commission; and

3.) There is a reasonable probability that the discovery sought will be lost
before the end of the aforementioned administrative proceedings.
